Mr. McNevin is a fine officer and has been given many awards for his service over the years. He even saved a family of four from carbon monoxide during the hurricanes in September of 05. Had any done research and the so called lady of this case you would see that she refused to follow directions numerous times and that she attempted to strick the 2nd officer on the scene that was in the car. If you all bother to watch the entire video of what happened you would notice that he gave her numerous attempts to follow directions. But no, make comments based off of clips that have been edited to make him out to be a bad officer. I believe what he did was fair and just.

If you would have watched the whole video, you would have seen that the lady was a complete bitch right off the bat with him. She should have listened to him the first 6 times he warned her and that would have never happened. So, since you were wondering if his family is proud of what he did, I’m here to tell you that the answer is YES, he was totally justified. I’m sure the family is quite proud that he successfully electrocuted her after she refused to exit her car. After watching the video several times I came to the conclusion that I would not have wanted to be either the Police Officer or the alleged victim. Mostly my thought was perhaps the officer should take part in more training with regards to the appropriate use of the taser weapon. Then again I’m not in Law Enforcement and it does seem to be an extreme measure to take when a tax paying citizen can be zapped just for refusing orders. We do still have some rights, don’t we?
But let’s not call names here, there isn’t any proof that Mr. David Williams is either Big or Bad.

Mr. Big Bad McNevin weighs all of 170 pounds. She was screaming “you racist” from the moment he pulled her over. It was a set-up from the get-go. I also know he works traffic homocide, and sees the result of speeders day in and out. What should he have done? Let her go? She broke the law. About four laws. Putting down the phone and cigarette is a pretty simple request. How is he a punk bitch? Because he feels an ambush might be at hand because a defiant law-breaking citizen was telling who-knows-who on the cell phone where she was at? When will people, white, black, green or whatever color realize all you have to do is obey the posted laws and we would not be here discussing this subject. Be grateful that Officer McNevin and others are willing to risk their lives for such a large population of hateful, ungrataeful people. Regardless of color, whichever you may be, obey the law. It’s that simple. By the way, Mr. David Williams,who elected you God? Who decided you should declare a Jihad on Officer McNevin? First of all a human being can tollerate being tased. As a matter of fact the police officer that tased this woman I know for a fact has tollerated it. Not becuase I know him. Because unlike most of you ignorant baffoons I know the law. Officers that carry tasers and/or mace must first be subjected to these non-lethal tactics in order to lawfully use them. Secondly, If the cop had been black and the woman was a soccer mom driving a lexus most likely she would not have cursed the police officer out, known that she had broken the law, and would have been respectful to the situation. That doesn’t go to say only a white woman would have acted like that. Any man, woman or otherwise with CLASS would have understood how a decent ACTUAL law abiding citizen would act when wrong has been committed. I too personally know Officer McNevin and I can’t believe what he has ben put through, villification at the hands of liberal right wing extremists, for doing what he knows is his job – enforcing the laws of this country. If any of you had to face what he does every day and take the risk that he might lose his life enforcing the law, you might view his actions a little differently. He absolutely understands what it means to use force and how it affects the lives of those who are subject to it. He is a family man and treats his wife and child lovingly and with respect. The girl deserved it.
1. She opened her door when she was pulled over — You do NOT do this, as the person in the car could jump out at any second and threaten the officer.
2. She was not complying with the officer’s requests in a timely fashion, and was being hostile/confrontational.
3. She was driving on a suspended license (which could suggest a lot about the character of the driver, considering that she is probably knowingly driving on the suspended license).
4. She was resisting arrest.
5. She would not put down her cell phone when told to. This may seem like something silly, but there are a lot of cell phones that can be modified to fire projectile weapons or mace (such as through the antennae). Additionally, you can clearly hear in the video that she was talking to a “Mark,” whoever that was, telling him exactly what was going on. In a case like that, considering the person and how disagreeable she was, it could have been a request for help from an unknown third party.
6. She assaulted a police officer. She hit one of the officers involved in arresting her.
7. While she was on the ground, she would not turn on her stomach and place her hands on her back. In the time she did not do so, she could have drawn a concealed weapon and attacked either officer (since she was facing them and able to see them, and not the ground).

The girl was very smart. It seemed like she knew what she was doing. She was stalling, she asked for the officer’s name and badge number (to which the officer replied that he would be in court, so it wouldn’t matter), she made a big fuss/scene as to draw attention to her and probably coax a sense of pity into any witnesses that were present, she used a cell phone to contact somebody and let her know of her whereabouts — all of these, coupled with non-compliance, merited use of the taser. Even though it was passive resistance, the passive resistance harbored a sense of danger that the officers could not risk. She would not step out of the vehicle when she was told to, and she was told MULTIPLE times, and WARNED multiple times that she would be tazed, yet she did not comply. She even relayed this information to who was on the phone: “He’s got a gun, he’s going to shoot me.” Tazing the lady kept the officers safe and also would prevent any additional damage to the lady (trying to pull her out of the vehicle would have likely resulted in bruises, cuts, and such on both parties’ ends), and considering that she actually took a swing at one of the officers, she surely would have tried to ‘defend’ herself by whatever means necessary, especially considering she had a ‘witness’ on the phone to hear every detail of the ‘assault’.
Innocent bystander? Pah. She was driving with no seatbelt, a broken windshield, a bad brakelight, with a suspended license and tried to resist arrest while assaulting a police officer.

Somehow having the right to a phone call from the jail was looking pretty good after the fact. I can’t believe the restraint that the officer showed during the barrage of disrepectful comments. I for one would have tased her a couple more times.

The officer had already established that there was a multitude of violations, speeding, no seatbelt, broken windshield and tail-light, and driving under a suspended license. These all called for the driver to be arrested. If you had committed all of these violations, would you get out of the car when the officer told you to? If he pointed a taser at you after repeated attempts to get you to exit the vehicle, would you get out then? Or would you sit there and talk to your homegirl on the phone some more? He had multiple reasons to pull her over, and she said that because he was white, and she was black, he must be a racist. Yeah, that makes sense. What if this had been a black officer that did all of this, and followed the same procedure? There would not have been this uproar, at least not as much, and even though the race card wouldn’t have been able to have been played, he still would have been called an Uncle Tom. Racism is assuming negativity in a person simply due to their race. So since the officer is white, and he’s only stopping her because she was speeding, not wearing a seatbelt, with a broken tail-light and windshield, and eventually an suspended license, he must only be picking on her because she’s black. Who is the racist here?

Watching the video we she her blonde hair flinging around and she falls from her Lexus SUV onto the pavement scratching her smooth tanned skin.

I have seen the whole video – it doesn’t matter if she had no licence, or didn’t hop out of the car in a split second – his condescending voice, his obvious sadistic nature, rather than being polite, provoking her with his sarcastic and dismissive responses – looking for any excuse to cause harm and pain to another person. First off to Erik from France, get real. Police Officers are paid to enforce the laws, not be camp counselors or mothers. Show devotion and understanding towards what? A disrespectful and ignorant motorist who violated 4 traffic laws while operating a vehicle illegally and then proceeded to insult the officer and ignore his commands?
The fact that someone pays taxes(last I checked we all did) does not give them the right to ignore the laws and those that enforce them. She was treated as she was for refusing to act on the commands given by the officer. Several times she was told to get out of the car, several more times she was told to get out or be tazed. Ibnstead she decided to talk on her cell phone. The officer acted in the most appropriate manner given the situation.
Your comparing this police officer to a Nazi is sickening, ignorant, and truly makes me sorry for you.
Those of you who have actually watched the video in its entirity and still defend the actions of the woman while condeming the officer seriously interest me. It makes me wonder if you are the same people that bitch when officers do their jobs, claiming infringements on your rights, then when you yourselves need the help of those officers bitch about the percieved lack of action. The police deal with the most dangerous people in our society. When we encounter them, they are unsure if we are insane criminals or regular people running late for work. I tell my young kids that any interaction with the police is potentially a lethal situation. This young woman was obviously too stupid and too full of herself to realize that.
I agree with the local police commander who was satisfied with McNevin’s performance. No one was seriously injured. And I also agree that it is not the Police’s job to get in street fights. If you are caught breaking the law and refuse to respond to police commands, then expect a Taser. Remember, if Tasers were around before then Rodney King never happens.

What if she had drugs/weapons in her purse or under the seat and was going to shoot the police officer. Someone said a person should not be tazered for disobeying a police officers orders, are we allowed to disobey police now? I just want you to put yourself in his shoes and tell me the appropriate action you would have took. Remember, you do not know who is sitting in that car, a felon, a fugative, someone high on drugs/alcohol or if there are weapons hidden and the person is willing to doing anything to get away. Never judge unless you know what the job involves.

Sorry – Googled over here after seeing the video on a livejournal com, and just wanted to put in my 2 cents.
I felt very sorry for that woman after she got shocked, because I’m sure that hurts, but, and I’m a card-carrying bleeding heart liberal speaking, mind, I don’t think the officer was wrong.
He maintained a very professional attitude throughout the whole thing, and repeatedly told her instructions that she ignored.
From the get-go she was argumentative, telling him he wasn’t ’supposed to clock people when he was driving’ or something. Up until the tazing incident, he never raised his voice, didn’t curse at her, and continued to be polite. He did his job.
I do agree that police officers represent the law, and as such representatives, they can’t give into the feelings and urges a civillian would have – had he continued to taze her even after she were cuffed, if he kicked her in the stomach when she was on the ground, that would have been wrong, but he didn’t. He went by the book, tazed her only after warning her at least 4 times that he was going to, and, face it, she’d broken the law.

In the UK they tazer suicide bombers who may be about to blow themselves and the officers up, and in the US they taser awkward women who don’t want to get out of cars. Hmmm… seems a bit excessive to me. The USA revels in culture of violence, including state sanctioned killing stretching from the Native Americans in the 1800’s to the death penalty now; and dropping more bombs on Cambodia than were dropped in the entire WW2 by all combatants, and onwards into Iraq. Their job is to protect people from the real dangers. Their job is about helping. It is about being a friend. About making people feel safe and happy. We teach our children these things about police. But the harsh reality is you have to fear the cops. These people have no decency or shame. So what if they told her to get out of the car numberous times? Why should she listen to them, what are they, God? They are no better, no worse than her. If she was someone who hurt others and was a danger to society, that’s a different story. Every single day I pick up the paper and read about rapes, robberies, killings, carjackings, and the same end line “no suspects were arrested”. THESE are the type of crimes they have to persue. Not this trick-or-treat stuff. If she wanted to make a call, let her finish. Then they say that she tried to swing at them…they grabbed her first physically, she had to defend herself! After reviewing the tape I have to say that the subject was defiant and probably deserved to be tased. What I don’t agree with was the second tasing. The subject was already on the ground and all Officer McNevin had to do was place her hands behind her back and cuff her.

His interactions with her were calm and polite. Officer McNevin was MORE than justified in his actions. It makes me sick looking at all the whining that people make of “unjustice” or “brutality.” He never once struck her and was, infact, very polite considering the verbal abuse he was put through. The weapon is NON-LETHAL. She lived and had only about 10 seconds of pain, even though she made it sound quite different.
As for “Patriot.” Calling the Officer a “Piggy” shows your age. Chances are, you are not old enough to vote, so I brush off your opinions as, simply put, childish.

When we (law enforcement officers) are attempting to enforce the law, and we have a non-compliant subject who refuses to follow orders, it is our responsibility to use the appropriate amount of force to pressure the subject into doing what we need them to. This woman berated the officer for the first five or six minutes of the stop, which included calling him a racist, and trying to tell him how to do his job. The officer’s number one priority is his own safety. Despite the nobility of the profession, our major goal each day is to simply come home alive. This means being cautious when it comes to resistant subjects, and includes not putting ourselves in any unnecessary, potentially harmful situations. Officer McNevin warned the woman twice before trying to physically remove her from the car. She actively resisted, at which point he drew his taser (non-lethal force) and proceeded to warn her SEVEN times that if she didn’t comply, that he was going to tase her.
We, as officers, do not have three hours to wait on every single resisting subject who wants to make phone calls and have a cigarette before they “allow” us to arrest them. We are not arresting them at their convenience. The woman in the video didn’t follow the lawful order of a law enforcement officer in the course of his duty, and was warned seven times of what was going to happen before she was tased. She had ample time to follow the order, and personally, I think Officer McNevin waited too long before he actually tased her. I probably would have done it after the second warning. If she hadn’t broken the law, and hadn’t mouthed off to the officer, and had complied when he instructed her to put down her phone and cigarette and get out, then she wouldn’t have had to deal with the consequences.
Also, please note that the principle behind a taser is electric current, and the fact that when it is running through the body of a living thing, it causes the muscles to contract to the point of incapacitation, causing severe pain as long as it is being actively used. Once the 5-second timer runs out, the taser goes dead until the trigger is pulled again, and the contractions and pain cease. The electricity does NOT linger in the body, and does not stay long enough during the actual tasing to do any permanent damage. Most people hit with a taser are fine almost immediately after the current stops. The woman in the video was quite obviously hamming it up for bystanders and the camera in order to make it look a lot worse than it actually was.

I too googled here having seen this clip on another website.. I have seen other clips where police officers in the US have been shot at and brutally attacked under standard traffic pullovers. I think these are people who in the line of duty often get put under allot of stress. Police officers in Europe just don’t see this kind of violence in their job. Now, arguably I could say that I think officer Mcnavin was being kind of a jerk and this woman was obviously being a jerk too (or bitch, whatever).. But, being a police officer he probably deals with ignorant ppl like this on a daily basis so imho maybe he could have handled it with a little more compassion, I dunno.
From what I saw she didn’t seem to be a threat to anybody. They claim she tried to punch the other officer, hehe. I mean a woman like this couldn’t even deliver a harmful punch to this officer standing up let alone from a sitting position. how many times have any of you been tasered? when i was 19 i shoplifted a pair of boxer shorts from wal-mart. as i was leaving the security guard grabbed me and i got violent with him and assualted him, but as i ran around the corner of the exit my ass got popped with something that put me on the ground quick, i had been tasered. much better then being shot. i had no “freeze” or “dont move”, but ya know, i was breaking the law and i dont think i would steal anything else from anywhere, just for the tasering i got, not to mention the 30 days in jail and about 2500$ of fines. but what i did was wrong and deserved what happened. i guess since it was a black cop and im white i should have called racism, but i know how to deal with things i do.

After being pulled over with about four violations, one of which is operating without a liscense, shes going to be arrested. This chick decides she is going to be uncooperative, like she did. McNevin decides not to use is taser and after a half an hour of “Get out of the car” she still refuses. McNevin decides that there is no way she is coming out of the car and says screw it. She drives away, and three blocks later smashes into a car, killing everybody in the other car, but she walks away. Personally, I would rather have her tasered and arrested.

The officer was justified in his actions. Driving under a suspended license is an arrestable offense. She broke the law, plain and simple and she knew she was going to jail. Maybe she should have just pulled her out the windows and maybe she would have slammed on the ground. When an officer tells you that you are under arrest, that is it. There is no debate as the state law in which he works gives him the “power” to take away your freedom of movement. Arresting someone is not a punishment, it is to ensure that the arrestee will show up in court to answer for his/her actions. In Virginia, an officer has the discretion to write a summons for all of the offenses in this video. Unless the violator is a habitual offender of driving while suspended or the officer feels that violator will not show for court, then the officer may make a physical arrest. If I was the Officer, I would have pulled her over for doing 51 mph in a 35. Not because she was black. My family came from a long line of slaves. Do you know what that entitles me? Not a god damn thing. It just goes to show the ignorance of this woman. Racism is just that. Ignorance. I actually feel that the officer did this lady a favor by tazing her. He could have been a real a$$hole and shot her in the face with oc (pepper spray) and believe me, that is something I never want to experience again. Good job officer. The issue here is that the woman was not an immediate threat which is the only grounds for which a police officer is authorized to use a taser–as an alternate to lethal force. This woman did not pose an immediate threat to the officer, end of discussion, case closed. This is a clear cut example of police brutality by use of unnecessary force. Whether or not the woman gave them an attitude is irrelevant because that is not illegal. When asked to get out of your car by a police officer under the law you can ask why he wants you to do so. As citizens of the United States we all as civilians have rights that exist to protect from overbearing authorities. The officer was clearly angered by the woman’s knowledge of the law and her challenging of his authority which are not crimes. When there are two male police officers and one unarmed female there is no need for a taser. These officers should be prosecuted to the fullest extent of the law.

First of all I am a correctioanl officer and have been hit with bigger equipment then a tazer and that have more juice and yes it hurts, but it causes you to lose control of your muscles more then pain. Note to self: do not visit Florida. I like Jersey, where the cops are really bored. Seriously though, I hate people that talk on cell phones incessantly, but he should have showed a little more restraint. I think he showed poor threat assessment. If the suspect was 6′5″ and 300 lbs and aggressive, I would have sided with the cop whole heartedly. But you shouldn’t be tased just for being a “bitch” or passively non-compliant. Also, I would like to see some PSA’s on public TV regarding how people should react when approached by law enforcement. Stuff like “When pulled over, roll down you window and place you hands on the steering wheel, make no sudden movements, do not attempt to get out of the car, and comply with lawful orders given by the officer”. Also include what is and is not a lawful order and what to expect if you don’t comply with these orders. I think some public education could cut down on the number of incidents and actually save some lives.
Also, I think that everyone who posts inflammatory messages on forums to get a knee-jerk reaction from people should be tased by their computer. Just a thought. Might cut down on the nazi cop comments or “YOU ARE FREE TO LEAVE!” crap.

The officer used a weapon that has been proven to be fatal for a traffic offense. That is beyond poor judgment, and there can be no justification for it. She was not fleeing the scene, and she was not wanted for a felony. Additional backup was available. The use of possible lethal force was not a viable option. The officer should be fired and she should sue.

This officer showed astonishing restraint with someone that obviously has no regard for the rule of law. She had a suspended license, a broken windshield, a tailight out and she BLASTED by him in a 35mph zone. She belongs in jail.
All that screaming and crap looks great on tape when the cops are putting the handcuffs on, but it’s all drama. I guess the next argument (besides the weak and oft used “racist” one) is that they should have had something better to do.

The officer screwed up. If he had ordered her to throw the keys out of the car and she did not comply, *then* he might have reason to tase her, as the vehicle itself could be considered a weapon.

As far as the rest of you idiots defending her saying she got popped because of a traffic violation, I’m almost inclined to not write anymore, as you’ve probably all failed to even read this paragraph properly, but here I go. #1, she was tazed because she repeatedly defied a lawful command to exit her vehicle, and acted aggressively with the cops. Plain and simple, and the cops had every right to act in that way. #2, it most decidedly IS a crime to talk on a cell phone when an officer has instructed you to get off of it in a situation like this. By any definition, that is a lawful order from a sworn, commissioned police officer. At that point, she had no right to do anything besides put her phone down and step out of the car.

I think that the tasing could be legally justified, but does anyone really doubt that it was more than likely not required?
Cops have a tough job and I have a lot of respect for them (in fact, my sister is a Probation Officer). This woman was defiant and rude, but she was also scared when she had a gun point at her.
I believe he did not violate the letter of the law and I don’t believe he should be punished. However, I also think it’s boderline to suggest he didn’t violate the the spirit of the law. Ultimately, I think he tased her because of her attitude and not because he felt threatened. My guess is he wouldn’t do it again. I’m sure he’s a good person, but this was boderline and a different cop with a different approach could’ve had a better resolution.
Again, I’m not defending. I thought she was awful.

I just saw the video in its entirety.
I saw the officer doing his job. I saw too that the officer would rather be somewhere else than to deal with this type of individual(argumentative motormouth).
The officer showed restraint(more than I would have – for me 3 strikes and your out!)with an individual whose first language was english.
One of the rules of the road is that you obey the police. I see lawyers do it all the time. She was in the wrong….committing an offense and then compounding it.
Use of the taser being excessive? I have seen many who use it on themselves at parties.

He probably, went to grab her to pull her out of the vehicle, then McNevin, while she was distracted (at the same time- not knowing, nor being informed of being arrested- {remember almost anywoman would not let a man touch her out of the blue}and swashing away, the other police officer.
This Is when she, was, stuck by the brutal electrical force of the ‘Taser’ from the drivers side of her vehicle.
Seeing how, the short pretence of the entire word, ‘Taser’, is used in it’s shortened terminoloy, that this officer, is refering to his full experience and usuage of Tasering people, has narrowed the word, down to a ‘T’.
“Yo! Biatch, now yous best don’t want me ta go usin’ da’ ‘T’ word onz ya’!” But he never even tried inform the woman she was going to be apprehended.
Not, only does the approaching Officer state that the woman had taken a swing, that after the Tasering had taken its affect on this woman, not once, but twice, after in which she was helped to stand, by both Officers, that the Officer told her afterward, that she was being arrested for- driving with a suspended license.
(before they Tasered-zed-zed-zed-ed ‘Zapped her’-) None, of which made itself audibly present- in any part of this -vocal content- till after she was apprehended. That, neither of the asshole Officers involved- their approachment to the Driver of the Vehicle stated that was what she was being arrested for…
ALthough, this situation was posted all over the internet in police chat room forums, none of which more that a few people have sided with the woman, and the rest, (mostly cops themselvesor family members of the cops- trolling the internet) going…. “I told you so… She should have listened…”

It is interesting watching the video. I find it amazing that anyone would watch the video and believe the use of a taser was justified. From the time he told her he wanted her out of the car to the time he shocked her was less than 35 seconds. From the time he told her he was going to tase her to the time he did was about 20 seconds. She was clearly emotional. He had backup. He could have talked he out of the vehicle without using force. Instead he allowed his emotions to get the bettero of him.
I do not blame him though, as much as I blame the system that trained him and armed him.

I know quite a bit about the taser and what it feels like. Someone with a heart condition can handle the Taser. The ignorance of people astounds me. The Officer did everything he could to get her to cooperate. She could have been injured if he had to struggle with her. the taser is 5 seconds of what feels like a muscle stimulator turned up on high is. It does not stop hearts. It works on the path of least resistance i.e. the outer layer of muscle tissue. She was fine afterward. Sure it doesn’t tickle but she was not injured. 1. Female in question was an outright b*tch who deserved a b*tch slapping. She makes a really bad example of a victim of excessive force.
2. Unfortunately, cops are not allowed to deal out such punishments and “mouthing off” to a cop isn’t a crime. It is POPO (piss off police officer), which is stupid.
3. The “violence” that “escalated” the situation according to Sgt Sedrik Aiken (training officer for McNevin’s department) was the female pulling away from Officer McNevin’s grasp.
4. Taser Int’l’s training manual states: “The Taser is best utilized in situations where a hostile or potentially hostile individual is threatening himself or another person.”
5. The need to arrest was fairly obviously POPO driven, as was the sudden adding of three additional traffic violations (one of which was real silly, since the failure to wear a safety belt was only observed and brought up after the stop had been made).
6. Off McNevin could have taken a number of other measures that didn’t include an arrest, including ticketing her with a court date and informing her that if she drove the vehicle away, she would be arrested then. If he felt real pissy, then he could have taken his time filling out the tickets, possibly provoking a physical confrontation. (Yep, seen that one myself, except it was a “he” and I simply swapped places with the driver since my license wasn’t suspended. In Florida.)
7. Off McNevin acted in a hasty manner (~6 minute episode, less than that to tasing), did not use less confrontational methods of resolving the situation and escalated the situation himself, including use of excessive force. You can say his defense is that he was following orders/training, which would work for me, but then you need to haul his superiors in to take the rap.

I agree that the woman was stupid, obnoxious, loud, etc. (but those aren’t crimes) and she was not an immediate threat to the officer or his buddy. They should have shown more restraint. Tazing her was the use of life threatening force against her attitude and big mouth.
They should be reprimanded, and potentially prosecuted.
We as citizens have a right to question Nazi strom troopers; and when asked to get out of your car by a police officer — you have the right to do so.
As an ex-police officer I’ve advised my wife and children to keep the window rolled up and door locked when approached by one of these thugs. And at night, I’ve advised them to drive to the nearest police station before pulling over to be safe from copy-cat-cops and the few steroid doped-up uber-criminals dressed in uniform.
Two armed and dangerous cops against an unarmed woman… they couldn’t call a supervisor, or the race relations officer, or a woman officer.
I’m sure Rich is a really nice guy, that is, in most situations. I’m also sure he would risk his life, to run in to save anyone else’s in a dire life-or-death situation. But hey, I would too… and I have. But a mistake in judgement like this has to be dealt with seriously, or else it erodes all our rights.
BTW, If he’s tazing unarmed woman because he’s afraid for his life, it’s time for him to go back to school, get a degree in accounting and quit being a police officer. His wife and children will appreciate it as well…

I believe officer McNevin was correct in Tasering the woman the first time, this was done to get her out of her vehicle. I don’t understand the how the Officer can justify sending out a second blast from the Taser though. The woman was by this time, on the ground, and he stands there barking orders at her. He obviously doesn’t take into consideration that the woman is now scared, has just experienced a very painful shock, and may very well have injured herself after tumbling out of her SUV and onto the pavement. Any officer that would continue considering this woman as a possible threat by this point needs their head examined. He gave that second Taser shot because he could, not because the situation warranted it. She had already said she couldn’t get her arms behind her back while laying face down on the street. (I can’t, I can’t). So he lights her up a second time, and shouts the command again. She screams again in pain and then repeats that she can’t manuver her arms the way he wants. Then his partner wisely assists the woman in securing her arms. I suspect he did so because he realized McNevin’s actions had gone to far with the second Taser shot, and he wanted to prevent him from continuing his arbitrary use of force. Tasers used in this manner become an instrument of torture. I think McNevin relizes he went to far by this point also. This is further emphasied by the fact that he doesn’t mention that she took a swing at a police officer until after the entire incident was over, thus justifying, in front of the camera of course, his initial use of force. The reason I don’t believe him is the womans responce of “I didn’t take a swing at YOU”. McNevin knows the camera would show she didn’t swing at him, so he has to state, again in front of the camera, that the swing was at his partner. Since no actions inside the womans SUV can be seen by the camera, it makes sence he would SAY she swung at the officer who approached her vehicle from the passenger side. This same officer who is outside the camera’s view throughout most of the stop, thus making it a case of her word against two cops. I don’t think the woman ever made a physically threatening move at either officer, but a lie that she did would justify all the police actions that occured. Therefore, I feel the second shot from the Taser was abuse, plain and simple, a way to inflict pain for giving McNevin an attitude when the stop began. Since a bad attiude isn’t a crime however, there is no way to justify the second use of force.

She begins telling the guy on the phone that he’s going to shoot her. This is where the fun beings for defending the tasing..
Ofc. McNevin: “Get out of the car, now. Or I’m going to tase you. Get out of the car now or I’m going to taste you.” (He says it twice, and makes sure that she knows it’s a taser)

Ofc. McNevin: “I’m going to tell you one more time, get out of the car.” — and she’s ignoring him. You’re a jackass if you think it should go any further. By anyone’s account, she has defied the law numerous times, and she’s trying to get someone else there, as well. Why? Could be just to talk, or it could be to shoot the officer. They’ve been endangered at this point, no matter what your opinion is. He tells her AGAIN, and she ignores him, and tells her friend/brother where she is. Then, he tases her. I’ll defend that from here to hell and back. She didn’t listen. But you know what? After he tased her, she started to comply. Might hurt like hell, but every officer that carries one has to be shot with it to understand the pain it inflicts. It’s a far better alternative to a regular gun, by him, or by a third party.

I just typed my name in google to see what would come up, and I was pleasantly surprised. Not only did I find another Andrew McNevin (much props), but I also found a fellow McNevin (Officer Rich) laying down the law (pun intended) on a woman who could have easily avoided the whole situation. I believe Mr. Rich represented the McNevin clan (even our McNaughton brethren) quite well. There are 2 valuable lessons that can be derived upon viewing this video: 1) Do what a cop tells you to do so you don’t get tased, and 2) DON’T MESS WITH MCNEVINS!!!!!

One more thing. For anyone who is toying with the notion of a rebuttal, I have this to say. The woman would have been roughed up by any cop in that situation. The bottom line is she was being arrested, and refused to comply. What was Rich supposed to do, wait patiently until she decided to cooperate? NO! that’s not why I’m paying taxes. I want the fatass arrested. As citizens of a society, we forego certain luxuries/comforts to gain the protections that a society grants us. (I could get into Social Contract Theory and Rule Utilitarianism here, but I don’t have the patience). One of these societal protections is a police force. As citizens of a society, we are expected to cooperate with the police. If nobody cooperated with the police, the policing body would be worthless and the very foundations of society would crumble. So, In keeping with my previous posting, I will quickly compile a list of axioms: 1) Don’t break the law, 2) If you do break the law, be expecting an intervention with police, 3) During this intervention, it is your duty to do what the officer says (especially if force is threatened). If the officer is being truly unjust, swallow your pride, do what he says, and get a lawyer. And finally 4) Slap yourself for being in the position to be arrested in the first place. Anyone who blindly attacks Rich McNevin with emotionally charged banter (i.e. “He should be shot”) is engaging the typical pseudo-intellectual/liberal protocol. Please bring something real to an argument for crying out loud.

After reading everyones comments on here, I am left wondering a few questions.
1.) Why do about 90% of the posts attacking the police officer sound like they’re written by a 5th grader with absolutely NO knowledge of grammar?
2.) When did the ideas of “treating someone with respect” start to apply to only one side of a fight?
I’d like to take a step back and look at the crux of this entire situation.
If you disagree with anything in this next section, please emigrate yourself now.
There are two parties here: A citizen, and a police officer. The citizen’s job/responsibility is to do what? Think for a second. What is YOUR responsibility as a citizen of the United States? You are supposed to obey the law. If you do not obey the law, there are consequences. Don’t get off on a tangent now and chime in with “but! but!” Just allow me to give this simple point.
What is the job/responsibility of the police officer? It is to enforce the laws. “Erik from france” made the… eloquent.. statement that it was the police officer’s duty to “treat this woman well, give her respect, have self control, courtesy, devotion (?), and understanding towards the population that he is supposed to protect”. Nowhere in a police officer’s job description is any of this listed. This job is to uphold the law, and penalize those who break it.
Simply stating these facts, let’s look at what happen.
The citizen broke the law. We’ll discuss “black/white/white/black” issues later, right now we simply know that 1.) a citizen’s job is to obey the law, and 2.) this citizen did not obey the law.
What should the action of the police officer be to a citizen who does not obey the law? Should he DO HIS JOB and uphold the law which his position as a police officer requires him to do? I believe so, and, if you don’t… you’re retarded and desire complete anarchy and a complete lack of any responsibility for actions taken by people who break the law. Go kill yourself now and stop reading.
The arguement CANNOT possibly be about the officer’s INITIAL response to a speeding car – he pulled the car over. What happens from then on is a difference of opinion as to how he handled the situation, but NO ONE can disagree that because she broke the law, the officer was right in pulling her over. The problem with many people is that they try to place blame on parties who have no right to have blame placed on them. If the officer’s job is to uphold the law, and the citizen broke the law, how is he not justified in pulling her over? From the outset, yes – he may have not come up to her window and politely requested that she, if it was alright with her, calmly allow him to talk to her about something that slightly caused him to be perturbed but was in no way truly her fault but the unforeseen outcome of events she had no real control over – he did his JOB – his attitude is secondary – and do not forget that – SECONDARY – to what his job asks of him – to stop people who are breaking the law and punish them accordingly. The law does not state “if a police officer does not portray the attitude you wish to see, you are allowed to disobey everything he tells you and disregard every request/order he makes to you just because you don’t feel like obeying or have a problem with his order.” You realize, I hope, that while this is a democracy, not ALL things in country are run democratically. If a police officer, in a position of authority over you, demands you do something when he has pulled you over because you broke the law, you DO NOT have the RIGHT to ignore and berate him, openly disregarding everything he tells you to do. By simply BEING a citizen in THIS country, you agree to the fact that a police officer is allowed to do his job, and this woman, from the outset, had absolutely NO intent on compliance with anything the officer said. She was:
1. Speeding. Speeding is illegal, the police officer had every right to pull her over for speeding.
2. Driving on a suspended license.
3. Driving with a broken windshield and back light. These probably wouldn’t even have been mentioned by the officer if she was just compliant in the first place.
I read so many posts that portrayed the police officer in this villainous light like his sole goal in life was to “make people feel bad.” Pardon my language, but you’re all a bunch of pussies.
My final point is to ask you to take a step back and view this from the eyes of the police officer. This man has one job to do – be a police officer. His job entails several different things, day in and day out, and requires him to adapt to many different situations, put himself in harm’s way, and know how to act in a LOT of different situations. Because he’s a traffic cop, just try to imagine that there are… geez.. millions of potential “types” of people that he could have pulled over. This one happened to be a black woman, who from the very start, was looking for a fight. Every single person in this country knows and understands that a police officer holds authority OVER you, ESPECIALLY when you are being stopped for doing something illegal. Even if the woman was right that his stopping her was illegal, can I insert a little “WTF” here and ask why she decided to go all out and fight the cops when she KNEW beforehand that she was driving on an expired license? Put yourself back in his position… what would you think as you walked up to the car? Be honest – not politically correct.
“Oh great… I’m not even to her car yet and her door is already open… she’s calling me a racist, but she hasn’t even heard me open my mouth yet.. I guess it’s because I’m white, and she’s black, and therefore every action I take is apparently racist by nature. To me, that kind of sounds racist.. but whatever, I’m just trying to do my job.”
“Okay.. I’m trying to tell her now that I pulled her over for speedi-.. I can’t even get through my first sentence without her yelling at me. What the hell did I do? I am just DOING my job. I saw a car speeding, and I pulled it over… WTF is wrong with her? NO – I do not hate black people you idiot, NO, I do not even KNOW your brother. You can hate cops or white people all you want, but right now, please, shut the hell up and just listen to me. It’s not my job to be NICE to you – if you want, you can come down to the station later and we’ll have tea and talk about our problems, but right now, let me do my job. You’re making me angry. My job is not to have patience with you, my job is not to be nice to you. While I TRY to be nice to you, (because I’m a nice guy… not because it’s part of my job description,) the responsibility is more on YOUR side to give me a reason to be nice to you, rather than make me work for it, and so far you have given me not only NO reason to be nice to you, but almost EVERY reason I can think of to be upset with you.”
“Okay – yes.. yes.. I hear you, I’ll come back shortly dear and answer your question. I heard you the first time… my name is McNevin, and despite your persistence in questioning, there is no such thing as a unit number, you stupid bitch.”
Let me interject here – who the HELL does this woman think she is? The utter disrespect and unfriendliness that it takes to stick your head out your window and yell repeatedly at a police officer “WHAT IS YOUR NAME AND WHAT IS YOUR BADGE NUMBER? WHAT IS YOUR NAME AND WHAT IS YOUR BADGE NUMBER? WHAT IS YOUR NAME AND WHAT IS YOUR BADGE NUMBER?” like a broken record on repeat just… oh my lord… would have made me so angry. If THAT wouldn’t have gotten to you, I don’t know what drugs you’re on… but please give me some of them.

Okay, listen, you’re being pulled over and you light up a cigarette and start calling people? Are you mental? Put out your cigarette and hang up your cell phone. It’s (again,) not my job to sit here and WAIT on you. I am not a waiter, I am a police officer. In doing my job, I am telling you that you need to obey me. I’m not demanding something crazy from you, like strip naked and dance for me, I’m telling you to do something that ANYONE with common sense would do, but of course, no.. you have to yell at me – again – negate everything I’m saying and disregard every attempt I make at you to do something I ask. I’m tired of this. I’ve had it with this woman. She has absolutely NO intentions of cooperating with me, and she’s pissing me off on top of that. I’m opening her door and telling her to get out of the car. I’m putting her under arrest because of the six violations I already told her, but I’m sure she’s going to fight that too.”

Sorry – me again – at this point, the officer had to listen to 4 minutes of this woman screaming and crying like she just got put into the Rodney King hall of fame. She was NOT a victim of police brutality, and she was NOT abused by the police officers. SHe was a STUPID, non-compliant woman who did EVERY. SINGLE. THING she could to NOT cooperate, NOT listen, NOT respect, and NOT obey the officers who were going through the steps of a basic pullover with her.

She deserved EVERYthing she got, and about 20 times more that the police officers didn’t do.

I don’t disagree that the woman had it coming, she was speeding, on a suspended licence, no seat belt, broken tail light, broken windshield.
She then became defiant, combative, and refused to follow legitimate instructions from a police officer after being pulled over and the decision was made to arrest her. At that point, she chose her own fate. She was warned repeatedly to put down the phone (she can make her phone call from jail if she chooses), step out of the vehicle, warned about being tazed before (big surprise!) she get tazed.
The issue I have is where you say the ‘officers job is to enforce the law, and penalize/punish those who break it’. You cannot be more wrong. Their job is to enforce the law, arrest/detain those who break it.
It is up to the COURTS to determine and/or apply punishment and that is a very big distinction. Allowing officers to apply punishment to people for breaking the law would result in the very anarchy that you claim to abhor.
My two cents. If you don’t want to get tazed, well, put down the phone, get out of the car, and do what you’re told.

I believe that he was justified in his use of force, not because the lady was a threat, but because she was on the phone calling for “backup.” Listen closely and you can here her saying “Mark, I’m being arrested… I’m a on the next street over from Seacrest…” As an ex soldier and veteran of war, hearing that put one thing into my mind… AMBUSH! So, yes, I believe officer McNevin was completely justified in his action. I haven’t done anymore research into what became of this, but I would be highly upset if this ignorant citizen got any kind of compensation for what she surely deserved.

1. Please stop pretending you are police officers. If you were, you would know this is what standard procedure is. His only other options were to physically pull her out of the car, pepper spray her, or beat her with a baton.
2. I took a class in Peoria about a year ago. An optional extra was to be tasered. I did that. The taser causes no lasting effects. Once the five seconds of electrical current are over, it is done.
3. She was bleeding because she tried to pull out the barb from the taser.
4. There is a law against resisting arrest, ever heard of it?

What you all DIDNT see on the dashcam video was that when Sgt. Mcnevin’s tried to pull the suspect out of the car, she attempted to stab his partner with a pen. That is why he tased her and was fully justified in doing so.

Let me preface this by saying that I am about as liberal and in support of the rights enumerated in the Constitution as they come. I am a card-carrying member of the ACLU and believe everyone deserves a fair day in court. That being said, I’m also a volunteer with the local Sheriff’s Office, with a goal of someday entering that field.
In most states, the refusal demonstrated by the driver to exit the vehicle when asked is cause for a resisting or obstructing charge, in addition to the numerous moving and equipment violations. Despite being asked numerous times to exit the vehicle, put out the cigarette and hang up the cell phone, the driver continues to disregard the officer’s instructions. I’m not certain what the policy of the Boynton Beach Police Department is when it comes to use of force, but in many agencies, passive resistance is all an officer needs to deploy various control techniques and devices, sometimes including the TASER.
Could there have been other options? Perhaps. Ofc. McNevin could have gone ‘hands-on’ with the motorist, thereby risking the safety of himself, the other officer, and the motorist. If it is indeed true that the driver took a swing at McNevin or threatened to stab his partner, going ‘hands-on’ may not have been the safest or most logical choice. What’s more, in many instances, a ‘21 foot rule’ comes into effect when dealing with an edged weapon, such as a knife, sword, or (in this case) a pen. This ‘rule’ dictates that any time an aggressive subject comes within 21 feet of an officer carrying an edged weapon, the officer would most likely be justified in using lethal force.
The TASER is oftentimes a safer and more effective option then going ‘hands-on’ or using OC (pepper spray) or an impact weapon (baton). The 50,000 volts of electricity that are delivered for 5 seconds with each trigger pull certainly sound frightening, but have never SPECIFICALLY caused a death. Additionally, with the majority of TASER deployments, broken bones or other major physical injuries seldom result — and you can’t say the same about a ‘hands-on’ physical fight or impact weapon use. The only time anyone has died after being TASERed is when they were under the influence of a major stimulant drug, such as cocaine, and entered a condition known as ‘Excited Delirium’, and this condition is not attributed solely to the TASER usage.
It is my personal opinion that Ofc. McNevin acted appropriately and with great restraint in protecting the safety of all involved. When a person is that emotionally combative and agitated, it often doesn’t take long for them to become physically aggressive. From the moment McNevin re-approached her vehicle, the driver was non-compliant. Fearing for his safety, McNevin asked her to hang up her cell phone; he was probably not sure if she was calling someone else to the scene to be combative. Fearing for his safety, McNevin asked her to exit the vehicle. Fearing for his and the PUBLIC’s safety, McNevin deployed his TASER.
Are there racist cops? Unfortunately, we all know that there are, just as there are racist teachers, firefighters, and politicians. Did Officer McNevin take this course of action because he had pulled over an African-American woman? I sincerely doubt it. Had she been pleasant and not aggressive and non-compliant, chances are she would be in a lot less pain and legal trouble. It’s entirely possible that he would have written her a simple citation and released the vehicle to another party, letting her go on her way with just a few fines. Instead, she took a trip to the Boynton Beach jail, enjoying 3 hots and a cot on the dime of every other law-abiding taxpayer.
Officers are trained to respond to threats to injure, regardless of a person’s race, religion, sexual orientation, gender, or other personal background. Had a ‘white soccer mom driving a Lexus’ done the same thing, the result would have been the same. Before people fault an officer for simply doing their job, they should ensure they know the full background on each case.
